TNM Social is administered by Texas Nationalist Enterprises, Inc., on behalf of the Texas Nationalist Movement. By accessing or using TNM Social (the “Platform” or “Service”), you agree to the following Terms of Service (“Terms”). These Terms govern your use of the Platform, so please read them carefully. If you do not agree, do not register or use TNM Social. Mission Alignment: TNM Social exists to advance TNM’s mission to secure and protect the political, cultural, and economic independence of Texas. By creating an account, you affirm that you support this mission and will abide by our community standards that keep the Platform “on mission.” 1. Acceptance of Terms Binding Agreement: These Terms constitute a binding legal agreement between you (“User” or “you”) and Texas Nationalist Enterprises, Inc. (“TNM Social,” “we,” or “us”). By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. Updates to Terms: We may modify these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on the Platform and updating the “Last Updated” date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review the Terms periodically. 2. Eligibility and Account Registration Age Requirement: You must be at least 18 years old to register and use TNM Social without parental consent. If you are under 18 (minimum age 13), you may only use the Platform with the involvement and consent of a parent or legal guardian. Children under 13 are not permitted to use or register for TNM Social, and we do not knowingly allow such use (see also Children’s Privacy in our Privacy Policy). Account Setup: To access social features, you will need to create an account with accurate, current information. You agree to provide truthful information during registration (including your name, email, and any required details) and to keep it updated. You may not impersonate anyone or use false details. Supporter Status: By registering an account, you acknowledge that you are registering as a supporter of the Texas Nationalist Movement. Account registration signifies your support for TNM’s mission and community. If you do not support the mission or objectives of TNM, you should not use this Platform. We reserve the right to refuse registration or cancel accounts that appear to contravene the spirit of the community or these Terms. One Account; Personal Use: Each individual should register only one account. You are responsible for all activity that occurs under your account. You agree not to share your login credentials or allow others to use your account. You must notify us immediately at our contact email if you suspect any unauthorized use of your account. 3. Account Security and User Responsibilities Password Security: You are responsible for maintaining the confidentiality of your username and password. Do not share your password with anyone. If you believe your account has been compromised, notify the administrators immediately so we can help secure your account. Account Use: All activities conducted through your account are your responsibility. Ensure that you log out after each session on shared devices. TNM Social is not liable for any loss or damage arising from your failure to secure your account. Accurate Information: You agree that all information you provide to us, whether at registration or in your profile, is accurate. Providing false information or impersonating others (including other members, public figures, or TNM officials) is prohibited and may result in suspension. 4. Community Standards and Code of Conduct We are committed to maintaining a respectful, mission-focused community. By participating on TNM Social, you agree to the following Code of Conduct: On-Mission Content: Keep discussions and content aligned with TNM’s mission and principles. This platform is for pro-Texas independence activism and community-building. Content that purposefully undermines, disparages, or contradicts the mission of the Texas Nationalist Movement may be removed. Members are expected to uphold TNM’s values of respectful patriotism and not post material counter to our goal of a free, independent Texas. Respectful Communication: Treat all members with respect and civility. Personal attacks, harassment, bullying, intimidation, or abusive language toward others will not be tolerated. Debate and discussion should focus on ideas, not on attacking individuals. Slurs, hate speech, and derogatory insults based on race, ethnicity, religion, gender, sexual orientation, or any protected characteristic are strictly prohibited. No Harmful or Illegal Content: You may not post any content that is illegal, violent, or incites violence. This includes content that glorifies or encourages criminal activity or terrorism. Threats of harm or violence toward any person or group (including government officials or other users) are forbidden. Any real-life threats or encouragement of unlawful acts can result in immediate removal and may be reported to law enforcement if appropriate. No Hate Speech or Extremism: Content that promotes hatred, bigotry, or discrimination against any group is prohibited. While TNM Social is a forum for political expression (including critical discussions of government or policy), users may not advocate harm or use slurs toward any ethnicity, nationality, or demographic group. Posts should not cross the line into unlawful hate speech or extreme ideology unrelated to TNM’s mission. No Obscenity or Pornography: Pornographic, sexually explicit, or excessively vulgar content is not allowed. Do not post obscene material or graphic depictions of sexual or violent acts. Content should remain appropriate for a general audience. No Spam or Commercial Promotions: TNM Social is not a venue for unsolicited advertising or spam. You may not use the Platform to advertise products, services, or fundraising campaigns that are not authorized by TNM. Mass messaging, repetitive posting of the same content, or posting irrelevant links to drive traffic elsewhere is prohibited. Exception: TNM or moderators may allow certain promotional posts from official partners or affiliates; users should obtain permission before making any commercial solicitations. No Malicious or Fraudulent Activity: You must not engage in activities that harm the Platform or its users. This includes: Uploading viruses, malware, or malicious code. Phishing or attempting to obtain sensitive information from others under false pretenses. Scamming, defrauding, or deceiving other users. Data mining or scraping the Platform through automated means without authorization. Respect Privacy and Personal Data: Do not dox or expose others’ personal information. You may not post someone else’s private details (such as real name, address, phone number, email, or other personal data) without their consent. This also applies to TNM staff or public figures—while discussing public news is allowed, sharing personal contact or private info is not. No Impersonation: Do not impersonate any person or entity, including other users, TNM officials, moderators, or any public figure. Misleading account names or profile information intended to deceive others about your identity or affiliation is prohibited. Parody accounts must be clearly marked as such. Intellectual Property Respect: Only share content (text, images, videos, etc.) that you have the right to post. Uploading copyrighted or trademarked material without permission is forbidden. If you quote or reference external sources, give proper attribution. Do not post others’ work as your own. Repeated infringement may result in account termination. Relevant and Truthful Contributions: Strive to keep your posts relevant to the community and factually truthful. Off-topic posts that derail community discussions may be removed. Knowingly spreading false information, rumors, or propaganda not aligned with TNM’s mission (especially with intent to mislead the community) is not allowed. Community Collaboration: Moderation is a shared responsibility. Users are encouraged to report content or behavior that violates these standards. However, do not abuse reporting tools with false or frivolous reports. Respect moderators’ instructions if they ask you to adjust behavior or content. Language: While passionate discussions are welcome, maintain civil language. Avoid excessive profanity or grossly offensive slang. Content should remain within the bounds of civil discourse. Compliance with Laws: You must adhere to all applicable local, state, national, and international laws while using TNM Social. Do not use the Platform for any unlawful purpose, including but not limited to drug trafficking, stalking, fraud, or hate crimes. TNM Social cooperates with law enforcement as required to uphold the law. These examples are not exhaustive. Any behavior that administrators or moderators deem to be inappropriate, disruptive, or contrary to the purpose of TNM Social may result in corrective action. Remember, your access to this Platform is a privilege, not a right. We reserve the right to evaluate each incident on a case-by-case basis and take action at our sole discretion. 5. User Content and Intellectual Property Ownership of Content: You retain ownership of any original content (posts, comments, photos, etc.) that you create and post on TNM Social. We do not claim ownership of your works. However, by posting content on the Platform, you grant us a broad license to use it as described below. License Grant to TNM Social: By submitting or posting content, you grant Texas Nationalist Enterprises, Inc. and the Texas Nationalist Movement a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your content (in whole or part) for any purpose related to the Platform or TNM’s mission. This license allows us to, for example, share your posts within TNM communications, feature your content to promote the community, or retain backups of content. We will, however, respect your privacy settings and will not misuse private content. Your Content Warranties: You represent and warrant that you have all necessary rights to the content you post. Posting content that you do not have permission to use (such as someone else’s copyrighted article or a photo you did not take) is a violation of these Terms. You also warrant that your content does not infringe or violate any third-party rights (including intellectual property, privacy, or publicity rights) and does not violate any law. You agree that if any third-party claims your content infringes their rights, you will bear full responsibility for that and indemnify TNM Social as described in Indemnification below. No Liability for User Content: TNM Social is not responsible for user-generated content. We do not guarantee the accuracy, quality, or integrity of content posted by users. Monitoring and Moderation: We have the right (but not the obligation) to monitor, screen, and moderate user content. We may edit, remove, or restrict access to any content that violates these Terms or for any other reason at our sole discretion. This includes posts, comments, profile information, or any other content on the Platform. Feedback and Suggestions: If you provide us with any feedback, ideas, or suggestions for improving TNM Social or our services, you agree that we may use and implement those ideas without any obligation to compensate you. Such feedback is considered non-confidential and non-proprietary. 6. Moderation and Enforcement We take community standards seriously. TNM Social employs a multi-layered moderation system: community reporting, volunteer moderators, and administrators. By using the Platform, you agree to abide by moderators’ decisions and the enforcement actions described here: Reporting Violations: Users can report content or behavior that they believe violates our Code of Conduct or Terms. Reporting helps moderators notice problems, but false reporting of innocent content is itself a violation. We will review reports and take action as appropriate. Moderator Actions: Moderators and admins have full discretion to address any behavior they deem inappropriate. This means moderators may remove content, issue warnings, suspend or ban accounts, or take other corrective measures to keep the community healthy. Minor infractions will typically receive a warning or temporary suspension, while serious violations (for example, threats of violence, blatant hate speech, or repeated harassment) can result in immediate and permanent ban without prior warning. Your access to TNM Social is a privilege and may be revoked at any time for conduct that violates our rules or undermines our community. User Moderation Tools: The Platform may provide features (such as content “flagging” or up/down voting) that enable community moderation. Use these tools responsibly. Attempts to abuse or game the moderation system (for example, brigading to mass-report an opponent) are prohibited. Appeals Process: If you believe a moderation action (such as content removal or account suspension) was unjustified, you may appeal through the internal process provided (e.g., contacting the admin team or via a designated appeal form/email). Appeals will be reviewed by TNM Social staff or an appointed committee. While we will give appeals fair consideration, all moderation decisions (including the outcome of appeals) are final. There is no guarantee of reversal, and we have no obligation to explain our reasoning for a final decision. By using this private Platform, you agree that our decisions in enforcing the rules are conclusive and not subject to further review or litigation. No External Recourse: To the maximum extent allowed by law, you agree not to pursue any legal action against TNM Social or its owners/affiliates for the consequences of our moderation decisions. This Platform reserves the right to enforce its rules as it sees fit to maintain an on-mission, positive community. Content Removal and Account Termination: We reserve the right to remove any content and/or terminate any user account at any time, for any reason or no reason, with or without notice. This includes cases outside of rule violations as well (for instance, if we believe an account is a security risk, is engaging in unauthorized data collection, or if the user is found to be not in good standing with TNM). Terminated users may be blocked from re-registering without our permission. 7. Advertising and Third-Party Content Advertising on the Platform: You acknowledge that TNM Social may display advertisements, sponsorships, or affiliate promotions in connection with your use of the Platform. These could include paid ads from third parties or affiliate links that generate revenue for the organization. We will strive to ensure ads are relevant and not overly intrusive. By using the Platform, you agree to the presentation of advertising and promotions. Separation from TNM Content: Advertisements or affiliate content on TNM Social are not endorsements by TNM unless explicitly stated. We do not guarantee any claims made by advertisers. Any interactions or transactions you engage in with advertisers or third-party sponsors (such as purchasing a product or service) are solely between you and that third party. To the fullest extent permitted by law, the Platform and all content, services, or features provided through it are offered without any warranties of any kind, whether express, implied, or statutory. This means: We do not guarantee that the Platform will meet your requirements or expectations, or that it will be uninterrupted, secure, or error-free. While we strive for uptime and accuracy, we make no warranty that features (including notification delivery, content feeds, etc.) will always function as intended. We expressly disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No advice or information (oral or written) obtained from TNM Social or its representatives shall create any warranty not expressly stated in these Terms. We do not warrant that content provided on the Platform (whether by us or users) is accurate, complete, or reliable. Use of any information obtained through TNM Social is at your own risk. You acknowledge that any content download or otherwise obtained through the Platform is done at your discretion and risk, and you are solely responsible for any damage to your device or loss of data that results. No Warranty of Service Availability: TNM Social may be subject to interruptions, outages, or delays. We reserve the right to suspend or discontinue any part of the service at any time without notice. This includes, without limitation, damages for lost profits, lost data, loss of goodwill, business interruption, accuracy of results, or computer failure or malfunction, even if we have been advised of the possibility of such damages. Aggregate Cap: Our total cumulative liability to any user for any claims arising out of or relating to these Terms or the use of the Platform will not exceed the greater of: (a) the total amount (if any) you have paid to us for use of TNM Social in the 12 months prior to the claim, or (b) US $100.00. In many cases, users pay nothing to use TNM Social (it is generally a free service), so our liability to you may be $0. User Content & Conduct: We specifically are not liable for content posted by users, or for any misuse of your content by other users or third parties. We are not responsible for disputes or disagreements between you and any other user, or for any harassment, loss, or damage that may result from interactions with others on the Platform. Third-Party Activities: We are not liable for the actions or content of third parties, including advertisers, linked websites, or external services used within the Platform. If you follow a link to a third-party site or deal with a third-party (such as an advertiser or another member offline), you do so at your own risk. Service Changes: TNM Social and its owners will not be liable for any loss or damage arising from the modification, suspension, or discontinuation of the Platform or any part of it. This includes the removal of content or the termination of accounts as per these Terms. Indemnification You agree to defend, indemnify, and hold harmless Texas Nationalist Enterprises, Inc., the Texas Nationalist Movement, and their respective officers, directors, employees, volunteers, agents, affiliates, and partners (“Indemnified Parties”) from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: Your use of the TNM Social Platform or any services or features thereof; Any content you post or actions you take on the Platform, including but not limited to claims of intellectual property infringement, defamation, privacy or publicity violations, or any damage caused by your content; Your violation of these Terms or of any applicable law or regulation; Your violation of any rights of another person or entity (such as other users’ rights or third-party rights) while using TNM Social; and/or Any misrepresentation made by you. We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you will cooperate with us in asserting any available defenses). This indemnity obligation will survive the termination or expiration of your account and these Terms. 12. Termination of Service By You: You may stop using TNM Social at any time. If you wish to delete your account, you may do so through any account settings provided or by contacting us directly. Account deletion will remove your profile and personal information from active databases, but note that certain content you posted (such as comments in public threads) may remain visible to others, and we may retain backup copies of your data as required by law or for legitimate business purposes (see Privacy Policy on Data Retention). By Us: As noted, we reserve the right to suspend or terminate your account, or block your access to the Platform, at our discretion for any reason. This can include inactivity of the account, violation of these Terms or community standards, a request by law enforcement, unexpected technical issues, or discontinuation of the Platform. We may terminate accounts with or without notice. Effect of Termination: Upon termination of your account, whether by you or us, your right to use the Platform ceases immediately. The provisions of these Terms that by their nature should survive termination (such as User Content License, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution) shall continue in effect. No Service Guarantee: TNM Social has no obligation to provide access to the Platform forever. We may choose to shut down or archive the Platform at any time, for any reason. If that occurs, we will attempt to notify active users in advance and provide a way to download or save your content if feasible, but cannot guarantee it. We have no liability to you for any loss of data or content due to termination of service. 13. Governing Law and Dispute Resolution Governing Law: These Terms and any dispute arising from your use of TNM Social shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Jurisdiction and Venue: You agree that any disputes or claims arising out of or relating to these Terms or your use of the Platform shall be exclusively brought in the state or federal courts located in Jefferson County, Texas (which is the county encompassing Nederland, TX, USA). You consent to the personal jurisdiction of these courts for such purposes and waive any objections based on inconvenient forum or jurisdiction. Injunctive Relief: Notwithstanding the above, you acknowledge that unauthorized use of our Platform or violation of these Terms may cause irreparable harm to us for which monetary damages may be inadequate. We shall be entitled to seek immediate injunctive or equitable relief (in any jurisdiction) to protect our rights, in addition to any other remedies available. Attorneys’ Fees: In any action to enforce these Terms, the prevailing party will be entitled to recover reasonable attorneys’ fees and costs. Statute of Limitations: You agree that any cause of action you may have arising out of or related to the Platform must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred. (This limitation may not apply in certain jurisdictions that do not allow shortening the statute of limitations.) 14. Miscellaneous Provisions Entire Agreement: These Terms (along with any Community Guidelines/Code of Conduct referenced and the Privacy Policy below) constitute the entire agreement between you and us regarding TNM Social, and supersede any prior agreements or understandings (whether written or oral) relating to the subject matter. Any additional terms on the Platform (such as specific event rules or group guidelines) are incorporated by reference and are legally binding. Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of future enforcement of that right or provision. Similarly, a waiver of one instance of non-compliance does not mean we waive any later breach. Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to an affiliate, subsidiary, or a successor entity (for example, in the event of a reorganization, merger, acquisition, or asset sale) without notice to you. For clarity, TNM’s affiliates (such as Texas Nationalist Movement) are considered intended beneficiaries of these Terms to the extent they operate or are involved in the Platform, and are entitled to protections (such as the liability limitations and indemnities) as if they are parties to these Terms. Aside from that, no third party has rights here. Relationship of Parties: You and TNM Social are independent contracting parties. These Terms do not create any agency, partnership, joint venture, or employment relationship, and neither party has any authority to bind the other in any respect. Headings and Summaries: Section headings in these Terms are for convenience only and have no legal or contractual effect. Similarly, any summary of provisions (or comments in plain language) are for reference; the legal language of the Terms governs. Force Majeure: We are not liable for any failure or delay in our performance under these Terms due to any cause beyond our reasonable control, such as natural disasters, acts of government, war, civil disturbance, strikes, fires, pandemics, or interruptions of internet or communications infrastructure. Data Retention We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. This allows us to provide the service to you (for example, showing your posting history, keeping your profile for others to see, etc.). You can achieve this by: Deleting Your Account: There may be a self-service option in account settings to delete or deactivate your account. Using that will initiate the removal of personal data as described in Section 6 (Data Retention).
